Terms of Service

These Terms of Service ("Terms") govern your access to and use of the services provided by DETA (DESARROLLO ESTRATEGICO DE TECNOLOGIAS AVANZADAS), S.A. ("we," "us," or "our") through detahub.com, including our WhatsApp Business API integration platform, messaging tools, and related services. By using our services, you agree to these Terms.

1. Service Description

DETA provides a technology platform that enables businesses to integrate with and use the WhatsApp Business API. Our services include WhatsApp Business Account (WABA) management, message template creation and management, message delivery and automation, analytics and reporting, and related integration tools.

2. Eligibility

To use our services, you must:
• Be at least 18 years of age
• Be a registered business or authorized representative of a business
• Have the legal authority to bind your organization to these Terms
• Provide accurate and complete registration information
• Comply with all applicable local, national, and international laws and regulations

3. Account Registration and Security

You are responsible for:
• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Immediately notifying us of any unauthorized access or security breach
• Ensuring that all information provided during registration is accurate and up to date
We reserve the right to suspend or terminate accounts that violate these Terms or pose a security risk.

4. Acceptable Use Policy

When using our services, you agree NOT to:
• Send spam, unsolicited messages, or bulk messages without proper opt-in consent
• Distribute illegal, harmful, threatening, abusive, or discriminatory content
• Use the platform for surveillance, profiling, or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, age, or any other protected category
• Violate any applicable law, regulation, or third-party rights
• Attempt to reverse-engineer, decompile, or disrupt our platform
• Use automated systems to abuse or overload our infrastructure
• Impersonate another person or entity
• Use data obtained through our platform for purposes not authorized by the data subjects
You MUST obtain proper opt-in consent from end-users before sending them WhatsApp messages through our platform.

5. Meta and WhatsApp Platform Compliance

By using our services, you acknowledge and agree that:
• Your use is subject to Meta's Platform Terms and WhatsApp Business Policy
• You will comply with all applicable Meta policies, including the Developer Data Use Policy and WhatsApp Commerce Policy
• You will not use data received from Meta platforms in any way that violates Meta's terms
• We may modify or restrict your access to comply with Meta platform requirements
• Violations of Meta's policies may result in immediate suspension or termination of your account

6. Data Handling

Your use of our services is also governed by our Privacy Policy, available at detahub.com/privacy-policy. By using our services, you consent to our collection and use of data as described therein.
If you are a business using our platform to communicate with your end-customers, you are responsible for:
• Complying with all applicable data protection laws (Ley 81 de 2019, GDPR, CCPA, etc.)
• Obtaining proper consent from your end-users for data processing
• Providing your own privacy policy that accurately describes your data practices
• Ensuring that any data shared with us is lawfully collected and processed

7. Intellectual Property

All intellectual property rights in our platform, including software, design, logos, and documentation, are owned by DETA. You retain ownership of content you create or upload through our platform. By using our services, you grant us a limited license to process your content solely for the purpose of providing our services.

8. Service Provider Obligations

If you use our platform as a business to reach your end-customers, you must:
• Comply with the WhatsApp Business Policy at all times
• Obtain proper opt-in consent from your end-users before sending messages
• Not misuse the WhatsApp platform or our services
• Maintain accurate records of consent obtained from end-users
• Respond to data subject requests from your end-users in a timely manner

9. Limitation of Liability

To the maximum extent permitted by applicable law, DETA shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services, including but not limited to loss of profits, data, or business opportunities. Our total liability shall not exceed the amount paid by you for the services in the twelve months preceding the claim.

10. Termination

Either party may terminate this agreement at any time with written notice. We may also terminate or suspend your access immediately if:
• You violate these Terms or any applicable Meta/WhatsApp policies
• Your use poses a security risk to our platform or other users
• Required by law or regulatory authority
Upon termination, we will immediately cease processing your data and delete it within 30 days, unless retention is required by law. You must also delete any data obtained through our platform from Meta services.

11. Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Panama, including Ley 81 de 26 de marzo de 2019 sobre Proteccion de Datos Personales. Any disputes arising from these Terms or your use of our services shall be resolved through good-faith negotiation. If a resolution cannot be reached, disputes shall be submitted to the competent courts of the Republic of Panama.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page and notify you via email or through our platform. Your continued use of our services after changes are posted constitutes acceptance of the updated Terms. If you do not agree with any changes, you must discontinue use of our services.
